These Terms & Conditions (“Terms”) govern the use of the DealRevs Auction an Autodata auction platform (“Platform”). By accessing or using the Platform, all Sellers and Bidders agree to be bound by these Terms. 

Autodata only provides the Platform as a marketplace and is not a party to any transaction between Sellers and Bidders.

1. Platform Role & Disclaimer

    • Autodata is a neutral facilitator that provides an online auction Platform for Sellers to list vehicles and Bidders to place bids.
    • Autodata does not verify, inspect, or guarantee the condition, legality, ownership, history, or title of any vehicle listed on the Platform.
    • Autodata is not responsible for any actions, omissions, misrepresentations, or contractual breaches by Sellers or Bidders.
    • All transactions occur directly between the Seller and the Bidder, and Autodata is not a party to any sale, nor does it hold or transfer title to any vehicle.
    • Autodata is not liable for any disputes, losses, damages, defects, or fraudulent activity associated with any vehicle listed or sold through the Platform.

2. Seller Responsibilities

    • The Seller is solely responsible for accurately listing vehicles, including descriptions, disclosures, and any representations regarding the vehicle’s condition.
    • The Seller warrants that they have full legal ownership and authority to sell the listed vehicle.
    • The Seller retains the right to withdraw a vehicle from auction at any time before the auction ends without liability to any party.
    • The Seller is responsible for maintaining the vehicle’s condition until delivery to the Buyer.
    • The Seller is responsible for providing all necessary legal documents, including but not limited to the Original Possession Certificate, an Invoice, or an Ownership Transfer Certificate, within five (5) working days after payment confirmation.
    • The Seller is responsible for all taxes, duties, and fees associated with selling the vehicle.

3. Bidder Responsibilities

    • The Bidder is responsible for independently verifying vehicle details before placing a bid. All bids are final, binding, and irrevocable.
    • The Bidder acknowledges that all vehicles are sold on an “as-is, where-is” basis, with no warranties, guarantees, or recourse against Autodata.
    • The Bidder must pay the bid amount and all associated charges (e.g., VAT, Buyer Fees) within five (5) calendar days from the invoice date.
    • Failure to pay within five (5) days will result in the cancellation of the sale, forfeiture of any deposits, and a cancellation fee. The Seller may relist the vehicle at their discretion.
    • The Bidder is responsible for taking possession of the vehicle at their own risk and expense.
    • The Bidder is responsible for any fines, penalties, or legal issues related to the vehicle after the transaction is complete.

4. Buyer Fees

    • Every winning bid is subject to a mandatory Buyer Fee, as detailed below:

    • If a Bidder cancels a sale for any reason, they will be charged a cancellation fee of either 20% of the bid amount or AED 2,000, whichever is higher.

5. Disclaimers & Limitation of Liability

    • Autodata does not own, control, inspect, or verify the vehicles listed on the Platform and makes no representations regarding their quality, safety, legality, or ownership history.
    • Autodata is not responsible for failed transactions, non-payment, disputes, or any damages related to the auction process.
    • Under no circumstances shall Autodata, its affiliates, officers, employees, or representatives be held liable for any direct, indirect, incidental, consequential, punitive, or special damages arising from or related to the use of the Platform.
    • Autodata shall not be liable for any technical failures, errors, service disruptions, or system downtimes that may affect the auction process.
    • Autodata shall not be responsible for enforcing any agreements made between Sellers and Bidders. All disputes must be resolved directly between the parties.

6. Indemnification

By using the Platform, the Seller and Bidder agree to fully indemnify, defend, and hold harmless Autodata from any claims, damages, liabilities, costs, or losses (including legal fees) resulting from:
        a. Misrepresentation or fraudulent activity by the Seller or Bidder.
        b. Any legal disputes between the Seller and the Bidder.
        c. Failure to comply with local regulations or legal obligations.
        d. Any damage, loss, or liability arising from a vehicle’s condition, sale, or transfer.

7. Termination & Account Suspension

    • Autodata reserves the right to suspend or terminate any user’s access to the Platform at its sole discretion for violations of these Terms.
    • Any fraudulent activity, failure to pay, or misuse of the Platform may result in a permanent ban and potential legal action.

8. Governing Law & Dispute Resolution

    • These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which Autodata operates.
    • Any disputes arising from the use of the Platform shall be resolved through binding arbitration, with the arbitrator’s decision being final and enforceable.

9. Amendments & Updates

    • Autodata reserves the right to modify these Terms at any time without prior notice.
    • Continued use of the Platform constitutes acceptance of any revised Terms.

10. Acknowledgment & Agreement

By accessing or using the Autodata auction Platform, Sellers and Bidders acknowledge that they have read, understood, and agreed to be bound by these Terms. Autodata does not provide any warranty or guarantee regarding the outcome of any auction, the condition of vehicles, or the integrity of transactions.

Autodata acts solely as a digital marketplace and assumes no liability for any aspect of the transactions conducted on the Platform.
